Bequests play an important part in the future of disaster affected communities supported by Disaster Relief Australia. They provide income in perpetuity and enable us to plan for the future with certainty.
Disaster Relief Australia is committed to respecting the wishes outlined in the terms of the Will. If your client specifies in their Will a specific project or capability they wish to support, this will be upheld.
Suggested Wording
Below is some suggested wording we recommend be used in the drafting of a Will when your client wishes to leave a gift in their Will to Disaster Relief Australia.
The wording must specify the Disaster Relief Australia and the ABN 44 614 474 010.
“I ______________________ (print full name) give and bequeath to Disaster Relief Australia (ABN 44 614 474 010), of 1/299 Elizabeth Street, Sydney NSW 2000
a) All of my residuary estate, OR
b) ………………% percentage of my residuary estate, OR
c) The sum of $………, OR
d) [list of asset/s]
to be applied for the general purposes of assisting disaster affected communities OR for the purpose of ______________________ (specify project or capability area of your choice). I declare that the receipt of a Director of Disaster Relief Australia or other authorised officer will be a sufficient discharge to my executors, who will not be bound to see to the application of this gift.”
Deductible Gift Recipient Status
Disaster Relief Australia (ABN 44 614 474 010) holds Deductible Gift Recipient (DGR) Status Item 1 and is fully Tax Exempt.
Superannuation
Superannuation is not automatically directed through a person’s Will. If you wish to assign your client’s superannuation to Disaster Relief Australia, the balance of the fund will need to be left to their estate, in which case it will be dealt with as specified in the Will.
Capital Gains Tax on estate assets and transfer of shares
As Disaster Relief Australia is fully Tax Exempt, the transfer of all Capital Gains Tax assets such as real estate, property or shares to Disaster Relief Australia will result in significantly reduced tax liability, rather than pre-selling those assets by executors and transferring the sale proceeds.
